LEO Interaction while armed

If you know the date and time, you should be able to request a FOIA. IIRC, the officer's name should be on the document.

I'll drive by where it happened so I get the location right, then head to the station on Lockwood Blvd tomorrow.
 
in SC i dont think you have to announce that you have a CWP if you dont have a weapon. ( imagine walking through the courthouse telling every cop you see that you have a CWP)

thats what a couple of cops have said to me. that was back when it wasnt permanatly attached to my side.

any time they have come to my house i was carrying open and it didnt bother them, that i noticed, but they would be there because i had a stupid neighbor that called them when i would shoot.

once i showed them that my range was on the back side of the house from him and i was shooting away from his house anyway at a good backstop they understood that he was a nut.

we must have cool cops here. ive even told them i am packin and one said he didnt care as long as i dont shoot him. that was on my property though.
 
You're correct, Tigerstripe, there's no requirement to show an officer your Concealed Weapons Permit if you are not carrying a firearm "about your person".

I think people are mis-interpreting what one is statutorily required to do when being detained by law enforcement while legally armed, in SC.

If you're carrying a firearm about your person, and the officer "legally" asks to see your ID, then you must also produce your Concealed Weapons Permit.

You DO NOT have to inform an officer that you're armed when an officer asks for your ID, you ONLY need to hand him your Concealed Weapons Permit.

If the office doesn't ask to see your ID, then you have no requirement to show him your permit.

In my opinion, telling an officer you're armed is a good way end up with the officers gun pointed at you.

Please, don't give the government more information than legally required. In my opinion, giving the government too much of anything is a sure way to end up with a "police state". "If you give them an inch, they'll take a mile."
 
Well said. I couldn't find any law that required one to inform they had a gun. I was hoping those that insisted there was one could point my in the right direction.

Here's a question. If one doesn't meet the requirements of 23-31-215, is the penalty loss of your permit, loss of your gun, and jail time?
 
I contacted Charleston PD in an effort to find out which officer it was that pulled me over and searched me and was directed to the IAB and had to leave a message. If they don't get back to me in the morning, I think I might contact SLED about this. If they do this to members of the military while legally carrying a weapon, I'd hate to see how they treat anyone else. While talking with my dad, it came up that he didn't identify himself or give me an actual reason that he pulled me over (what law I was breaking). People like this shouldn't be allowed to be police officers. It's also making me rethink ever wanting to be one.

If you see something happening you disagree with, speak up or no one will ever know. We encourage input from our members. That doesn't mean we're going to stop people from sharing their opinions, however disagreeable they might be, but if you don't speak up about an issue, how can we discuss it and/or possibly change it?

You can bet you wont be getting some high class officers who give a shart.......I nor my other deputy buddies could CARE LESS if your armed....In todays day and age I prefer everybody have two guns on them or within reach. If you tell me your armed I WONT FREAK OUT...I will simply ask for your CWP...JUST THAT SIMPLE...You tell me the gun is in your glove box...Here again I could care less, I will tell you to go ahead and get what you need out of there... NOW...With that being said....You just go reaching in the glove box with a gun in there...BETTER HOPE ITS NOT THAT 19 YEAR OLD MAKING $19,000....Because your family will be rich but you prob wont be here. Just my two cents. Cops are not out to get you!!! Me nor any of my deputy buddies would ever care if you are legally carrying a gun...I can tell you we deal with the absolute scum of the earth. When we walk up to the car we dont know you are the most legal gun toting person in SC. We dont pull your criminal history before we get out of the car. We have 30 seconds of initial conversation to determine if you want to do us harm....If you have any doubt about anything I said in the last two sentences go to the officer down memorial page and sign up for email officer down reports and see how many cops get shot because they hesitate when they see a gun or better yet never see the gun. Now have a nice day!!!

I don't think anyone here has a problem with cops who follow their oath; only with those who violate our civil rights. And that does happen. We don't know who the good cops are anymore than they know who the good citizens are.
Just remember, being a cop is a chosen profession. They choose this job, they also need to choose to follow the law and not abuse it.

I'll add that I have personally gone up to several cops and thanked them for what they do, so please don't assume I'm a cop basher. I'm simply against bad cops.

Well said! I never meant to bash any cops. I have a friend who is a deputy for Charleston County, and another who works for Orangeburg Public Safety. I have even applied to several departments myself, because I believe that everyone who does something wrong should be held accountable for it. Up until recently, I have had nothing but positive interactions with LEOs. If you have taken the time to actually read the forum instead of come in here to bash us all, HBB, you would see that.
 
Roger. Message received...Hints the reason we have so many Law Enforcement Officers active on the forum. Dont think for a second we dont like forums...Most of us have several forums for everything we do. I have been approached by many LE Customers/Friends that have trolled the site deciding if they want to join and MANY have noticed in general that the site in general always has a negative attitude toward LE. They have mentioned it to me knowing that I am a sponsor and to take it a step further several have asked why I sponsor the site seeing that I am law enforcement. You might not pick up on the vibe we get because you are not one of us but its there. I sponsor the site because I LIKE IT and enjoy getting up in the morning and evening reading and posting where I can.Many of you are my customers and I love you to death....Im not going to fight or argue with anyone....I'm in business to help you folks...Personally and Professionally. Bad news always spreads faster than good news so I'm sure because I vented I have lost several of you as customers. Just know that it wasn't just me that noticed this trend on the site. Take it for what it is.
 
Henry, if you can please post specific references of cop bashing, I will submit it for review with the other moderators. I can understand how you might feel some of the opinions posted may be a personal slight, because you are bonded to your brothers in blue, but I don't believe any disrespect was intended to those who serve honorably, and I'm sorry some of your friends feel that way.
 
I have worked on law enforcement personnel when they have been damaged. I have worked on their Automobiles when they got wrecked. I have an uncle, a brother-in-law, a best friend, and an FFL who are or have been LEOs. As a child I was taught that the policeman was my friend. I hold the police I know in the highest regard. The ones I don't know I reserve judgement until I see how they operate. I do give them the respect they deserve for putting their a$$ on the line to try and keep thing civil.The image of police has been damaged by Hollywood, the media, and unfortunately, some officers who did not live up to the standards we have been taught to expect. As Henry said bad news travels fast and the media shouts the wrongs from the top of their lungs and whispers about the great and good things our LEOs do. People are in fear of their government. Rightly so if Fast and Furious is any indication of the high level corruption present. Henry tell your buds that many here are not bashing cops...they are whistling past the graveyard. Tell them to come on the forum and tell us about the good things they do and the real story behind some of the BS spouted on the 'News'. I think those of us from earlier times have a genuine respect for LEOs. The younger ones need to be educated. They need to know that most officers are standup and looking out for the law abiding citizen. The officers don't know who is behind that Permit. We as permit holders don't know what it is like to be wondering if this stop is going to be our last.
I don't have the all encompassing answer but communication in forums such as ours might be a good start. How are officers trained to handle situations? I know that they are trained to take charge of the situation. i know they have a COP voice and a civi voice. (I taught High School. I have a teacher voice and a normal voice) We(normal people) are so used to being deferred to by clerks we bridle at authority. Our younger folks have been taught to ignore authority. (They don't have the right to talk to me like that! I know my rights!) We are all so right we can't be wrong. Just a thought.

P.S. I'm on my 4th career. Lot of miles under these wheels.
 
I am supportive of law enforcement as a rule. Whereas with most people they have to prove to me that I can trust them, with LEOs I trust them until they prove me wrong... I have taught my son to always respect them as well.

I think that it would be interesting to devote a forum here to LEO concerns - maybe have a rule that all threads are started by LEOs, then others can join in. I would be curious to find out how a LEOs perspective on different topics may or may not differ from a civillians. I would bet that there would be discussions about topics that had never occured to me that impact their daily lives.

Just my 2 cents...

Also, I have never thought of us as anti-LEO on here, I wouldn't have stuck around this long if I did. (I admit that I may just not have been sensitive to it when it was out there..)

I want to reiterate that I have always had a good relationship with law enforcement. Several of my friends are current officers and deputies in SC and my dad is retired MP/EOD from the Army. I am currently serving in the National Guard and am currently in the application process for several police departments. The reason I applied to be a police officer is that I don't like seeing anyone doing something they shouldn't be. That doesn't exclude police or military. That was one of the hardest lessons I learned during my military training. Not everyone is a good person with honorable intentions and everyone needs to be held accountable for their actions.
 
HBB,i think on the average most people are not anti LE not just on the forum but people in general.just look at the county i live in(Spartanburg county).before sherif Wright was elected our LE did not have the best reputation.after he was elected he cleaned house fired all the corrupt officers.he now runs a tight ship by the book and he has overwhelming support now,heck i'm proud of him proud to live in spartanburg county and i've never even meet the man.he is a suppoter of cwp and is on tv atleast once a month encouraging law abiding citizens to get there cwp.

im right there with you on Mr. Wright. ive met him a few times. BIG guy.

when my wife and i got married a lot of people didnt show up so we called the sherriffs office and told them if anyone wanted to stop by Cleveland Park and have some chicken they were welcome. we got married on the island. i saw the sherriff sitting in a truck and walked over and said hello. he didnt come around later for the reception but thats ok, hes busy, but some of the deputys did.

call and ask for his secretary, ask her if he will meet you just to meet and ill bet he will tell you a time you could stop by.

i love his comments on TV. one was "its not brain surgery folks" i forget why he was saying that but it was cool.

i met him once when i went to get a form one signed.
