Don't have the minutes of the meeting (yet), but sources tell me California Senator and longtime gun-hater Dianne Feinstein's legal staff held meetings on Friday with FTB/ATF legal staff to discuss a new "Assault Weapons Ban" Madame Feinstein would be looking to push through Congress if President Obama wins reelection.

This same "pretty good intelligence" says the items that would lead to a ban would ban pistol grips and "high-capacity" magazines, eliminate any grandfathering and ban sales of "weapons in possession". I don't know about you, but if these things come to pass and I'm "in possession" I'm certainly not selling. In fact, the lack of interest in the idea surprised the California liberal's legal staffers. Apparently, they believe no logical person could possible disagree with them.

Combined with our re-elected presidents debate comment on a renewed / new Assault weapons ban, and his renewed support for the UN Arms control treaty mere hours after his re-election this has me somewhat concerned.

No sales - if you own it you can?t sell it between the time the ban passes and the time it goes into effect
No Grandfathering ? This is the provision that frankly scares me. It makes owning one of these retroactively illegal. If you bought it legally, and still own it when the ban goes into effect, you automatically become a criminal. I predict a rash of boating accidents, amd remind you to wear your life jackets. This one is an outright bid for weapons confiscation.

Feinstein went ahead and pulled the proverbial trigger. Other than those details which already leaked (which have yet to be confirmed), nothing is available about the propesed legislation. I urge everyone to start writeing their represenatives now in an effort to head this off before it build up any steam

In two of the above incidents the weapons were stolen from the rightful owner, and no legislation that prevented sales while not requiring surrender of legally owned weapons would have prevented them. In the other incident the person involved demonstrated that he wished to cause maxim harm, booby trapping his apartment in an attempt to injure or kill those who would be investigating his crime. No amount of weapons bans would have prevented him from causing that harm, only the items used would have differed.

If a person is determined to cause harm, they will not care about laws, gun free zones, or the magazine capacity of a weapon. After the World Trade Center bombing and Oklahoma City bombings I did not see calls to make diesel fuel and fertilizer illegal. I can still go to a gas station and fill a high capacity fuel tank. I can co to any number of hardware, Garden, or home improvement stores and purchase fertilizer. I can still rent cars and trucks. Cars and trucks alone are far more dangerous thatn firearms in the hands of responsible individuals, yet despite the number of drunk driving incidents every year, despite the number of motor vehicle collisions caused by speeding or unsafe driving, despite the number of deaths caused by distracted driving, I do not see anyone demanding background checks for drivers to purchase a car, or even get a license to drive. I do not see calls for people to turn in their vehicles every time someone dies as a result of a vehicular collision.

Do not allow those who wish to ban a category of weapons based largely on cosmetic differences to punish legal gun owners for the, admittedly horrible, actions of a few deranged individuals.

Obama has long backed the proposal, but chose not to push for it throughout his first term. Sen. Dianne Feinstein, D-Calif., plans to introduce legislation to reinstate the ban early next year, she said over the weekend.

But that?s not all.

White House spokesman Jay Carney says Obama would also support legislation to close the gun show ?loophole,? which allows people to buy guns from private dealers without background checks.

Carney explained Tuesday:

?He supports and would support legislation that addresses the problem of the so-called gun show loophole, and there are other elements of gun legislation that he could support ? high capacity ammunition clips, for example. That is certainly something he would be interested in looking at.?

Obama has pledged to address gun violence in the coming weeks, following Friday?s deadly shooting at a Connecticut elementary school. He told the nation Sunday at a vigil for the victims that we will have to ?change.?

Carney added that Obama spoke Tuesday with West Virginia Sen. Joe Manchin, a conservative Democrat and avid hunter who is now supportive of a national discussion on preventing gun violence.

According to Carney, Obama is ?heartened? by what he has heard from some members of Congress who have been ?longtime opponents? of gun control measures.

and with all this talk of mental health issues leading to the shooting i will not be surprised to see mental health evaluations of potential and current gun owners added in. Since something like 80% of all adults can be diagnosed with some form of mental health problems (lets start with ADHD and go from there) this is creating another layer of restrictive laws that could, potentially, keep anyone from owning a gun ever again. Feinstein to Introduce Updated Assault Weapons Bill in New Congress

Stops sale of more than 100 assault weapons; protects gun owners by exempting more than 900 specific hunting and sporting weapons
Washington?Senator Dianne Feinstein (D-Calif.), author of the 1994 Assault Weapons Ban that expired in 2004, announced on Sunday that she will introduce updated legislation early next year.

?On the first day of the new Congress, I intend to introduce a bill stopping the sale, transfer, importation and manufacturing of assault weapons as well as large ammunition magazines, strips and drums that hold more than 10 rounds,? Feinstein said. ?I am in the process of gathering support for the bill in the Senate and House.?

?I have been working with my staff for over a year on this legislation,? Feinstein added. ?It will be carefully focused on the most dangerous guns that have killed so many people over the years while protecting the rights of gun owners by exempting hundreds of weapons that fall outside the bill?s scope. We must take these dangerous weapons of war off our streets.?

A Justice Department study found the Assault Weapons Ban was responsible for a 6.7 percent decline in total gun murders. However, since the 2004 expiration of the bill, assault weapons have been used in at least 459 incidents, resulting in 385 deaths and 455 injuries.

A summary of key provisions in the updated bill:

Stops the sale, transfer, importation and manufacturing of more than 100 specifically-named firearms as well as certain semiautomatic rifles, handguns and shotguns that can accept a detachable magazine and semiautomatic rifles and handguns with a fixed magazine that can accept more than 10 rounds.
Stops the sale, transfer, importation and manufacturing of large-capacity ammunition feeding devices (magazines, strips and drums) capable of accepting more than 10 rounds.
Protects legitimate hunters and the rights of existing gun owners by:
grandfathering weapons legally possessed on the date of enactment;
exempting more than 900 specifically-named weapons used for hunting and sporting purposes; and
exempting antique, manually-operated, and permanently disabled weapons.

B.O.H.I.C.A. folks. I'm willing to bet that this time there will not be any pesky sunset date on any legislation she manages to put into effect. Write your representatives now. Write them often. it wont hurt, and might help

Really? You might want to refresh your memory of who voted for what in 1994.


ACTION PLAN:
- Stock up on mags. If in six months this all blows over put your AR mags in the "for sale" forum and I'll probably buy at least some of them. DOn't think of it as panic buying, think of it as hedging your bets.
- It is necessary to stiffen spines for the upcoming political fight. Write your senators and representative. Write John Boehner. Write Eric Cantor. Write, write, write. Send emails, phone calls, and physical letters. Get a stack of post cards and when you see an article from an anti- or hear a radio story that boils your blood, jot out a quick note. Write.
- Send money to pro 2A organizations. Second Amendment Foundation, GOA, JPFO, NRA, etc. Join them all. I know many do not like NRA, but you're delusional if you don't think they will be in the room involved in this one. Attach a letter with your position to your check and let NRA know you will never renew if they sell us down the river.
- Politely engage on social media and in the REAL WORLD. Divert to realistic solutions. Arming all kindergarten teachers with glocks is not going to happen. But ideas like allowing retired LEOs to carry in schools and pumping resources into the mental health system are viable. PoliceOne has a ton of good articles to link to and Dave Kopel just wrote an excellent article for the WSJ OpEd page.
- Educate about the difference between "assault rifles" (full auto, heavily restricted, cost more than cars) and "assault weapons" (made up term intended to confuse people based on cosmetic features; rarely used in crime despite recent high profile attack).
- Question anti-gun folks who are NOT religious zealots. Use the socratic method: "How do you expect a limitation of ten rounds per magazine to reduce the death toll in an incident like this? Are 5-year olds supposed to tackle the shooter while he reloads?" Or, "Hey, did you realize CT has a #5 ranking from the BRady Campaign for their tough gun laws? I wonder why they didn't work?" You'll never convince a religious zealot but a fencesitter who is reacting emotionally can be reeled in once they think a little bit.
- Give people the gift of knowledge for Christmas. I suggest a copy of "My Brother Ron," by Clayton Cramer. It makes a powerful argument for rethinking the mental health system with regard to violent paranoid schizophrenics.

Saying, "Oh, I'll just shoot the storm troopers when they come through the door" ain't gonna happen. If there is another AWB there will likely be grandfathering or at least a significant delay before implementation to avoid scenes just like that. They know they need registration before they can have effective confiscation and they'll push for it. How many stormtroophers got shot in the American Revolution of 1994 when the original AWB passed? Oh, wait -- didn't happen. Press box, voting box, jury box -- then cartridge box. If you don't have the will, intelligence, or passion to speak to your fellow citizens (press box) or influence your elected officials (voting box) what makes you think you'll take far riskier and more expensive road of the "last box?"

Though it has remained largely silent since the horrific school shooting in Newtown, Conn. last week, the National Rifle Association has reportedly registered about 8,000 new members a day since the tragedy

Additionally, Fox News, citing a source close to the situation, recently reported that the NRA would soon begin to ?push back? against gun control activists.

A massive spike in membership, and, having given the nation time to grieve, ready to push back against whats going on. Things might not be as gloom and doom as i was afraid of. I am concerned over the portion of their pre press release statement that said

?The NRA is prepared to offer meaningful contributions to help make sure this never happens again.?

but i am still hopefull. Right now the biggest problem i have is i am completely tapped out on available funds. hopefully prices will come back down again by feburary so i can actually afford some mags and other items when all this holiday overtime finally pays out

We will see what the NRA has to say on Friday. I've found they don't care much what I have to say or need from them regardless of whether I'm a member, not a member, a member threatening to not renew, or offering to pay for a life membership.

so the question is about to become "can an executive order overturn the constitution?" And even if the courts eventually say no what remediation is available,. if he orders all guns turned in tommorrow on pain of a felony charge what happens? if you turn your guns in and its overturned, can you sue for restitution? Would this violate the 2nd, 4th & 5th amendments (look ma, 3 with one shot)? What solution is available if it is found that this is unconstitutional, and you are arrested in the midterm?

Prices are about to spike more, the supplie is going to be even more limited too. a defacto ban is already in effect, simply because the items are not out there to be bought, or are so expensive almost no one can afford them.
