North Carolina does NOT allow private firearm sales without a permit for the sale. The Permit is $5. All handgun transfers in North Carolina, whether through a dealer or via private sale, or presented as a gift, require that the intended recipient of the handgun obtain a Pistol Purchase Permit from his/her local Sheriff. This is a North Carolina law, not a requirement for South Carolina (yet).

Bummer for North Carolinians. That seems to be a state law, not USC as has been previously asserted.
 
Correct, this does not appear to be a Federal requirement.

A few states do have this requirement; such as North Carolina, New Jersey, and Michigan.

it happened, several friends of mine work gunshows around SC/NC i knew about it that night.i do not know the guys personaly.i do know BATF agents arrested them.since i don't know them personaly i don't know the exact charge.i just don't want any forum members getting in to any trouble because they didn't know any better.John if you want to buy in public by all meens go right ahead that is your choice.

I never questioned whether or not two guys were arrested. I have no reason to disbelieve two guys were arrested for something, somewhere at sometime by somebody. That isn't really the point.

Don't take offense to my simple questions. You said something was against the law, and I'm always looking for ways to expand my knowledge, so it seemed like a good opportunity to learn about a law that I wasn't aware of. I find a good way to learn about a law is to actually read it, and luckily, they are all on line somewhere. It makes it really convenient to post links to them for discussion. If someone posts a link to it, I'll read it and know something I didn't previously.

I have bought and sold several guns in the parking lots of Lowes, Walmart, Bass Pro and other similar places and will continue to do it because it isn't against the law (unless I'm in NC or one of the other states that specifically prohibits it by state law as pointed out above).

So anyway, how about those stripped lowers in classifieds, eh.

1) Paranoid of the Big Brother Database. I wish some of you FFL's could give us definitive proof of how this database is impossible, that only the FFL has those records.
2) Can't pass a NICS background check.
3) Sales tax evasion :)

every ffl i've talked to about this says the same thing"all records of this purchase stay right here" since all of there stories are all the same i tend to beleave them....tax evasion????not so harsh.a private sale is perfectly legal and no sales tax are needed but i get what your saying if you buy private you get around the sales tax.back ground check....i don't want to stir this one up lol
 
The records do stay with the FFL.....but....ATF has been known to come in and make copies when they do their random inspections. Plus, when an FFL goes out of the business, those records get sent to the ATF. And even though ATF is supposed to just store them, I have read recently where they are being digitally copied.

Heck I even have a "complete lower" with "moe" stock, grip and trigger guard and "custom" paint filled roll marks I'd turn loose for $450
 
I've had a stripped lower on Iwanna for over a month now at $250, then $200, then best offer. Never even got one call - so I call BS.

I stand corrected. Were you simply testing my theory? I would personally be wary of anyone willing to pay much higher than retail. You didn't sway the results by including "CWP required," did you?

I think we may have progressed beyond the state of panic and back into numb complacency. Or maybe everyone is broke. It feels I have seen more AR's for sale in the classifieds lately.
 
No CWP requirement. I bought one of PSA's last in-stock lowers and swapped it out with my wife's lower (pictogram vs. safe/fire). I was more or less testing the waters, but I would like to sell the thing for at least $150 or so.

When I've sold a rifle face-to-face, I have a simple bill of sale form I use and attach a pic of the buyer's driver's license. If they feel suspicious, I don't sell. Never had an issue.

I would list it in the classifieds here but unless I'm doing it wrong, Post and Courier wants $30 to list any gun. I guess I could try craigslist and see if I get any takers before the ad is ganked.
