Update: this just passed the senate and is on its way to Governor Fallin to be signed. I can't imagine that she would veto it.
 
Agreed. Open Carry will likely be the law of the land in Oklahoma this November.

On a side note, the "Katrina" Bill was passed in yesterday's session and is also on its way to Gov. Fallin. For those who don't know, the Bill prohibits government agencies in Oklahoma to confiscate private arms during times of natural disaster, civil unrest, etc. If such an action were to take place it also provides a means of recourse to the citizen whose rights were violated, including reimbursement of court and attorney costs.
 
Is this pretty much the same bill that was vetoed by Brad Henry I read through quite a bit but i dont really have the time to read through the whole thing
 
Here is the deal......it passed. Now modifications can be made after the Govenor signs it, and she has indicated she will. The SDA law has been tweeked several times in our favor since it was passed, and guess what, no blood is running in the streets like the opposition said it would.

Well their is blood running in the streets. But its not because of law abiding citizens. Its those who arnt following the law doing 90% of the viloent firearms incidents.

Those of us that care enough to follow the law arnt going to freely throw away our rights/privilages.
 
The big thing is open carry will be legal. There's some clarification on duty to inform, so now you explicitly have to inform the LEO that you're carrying "at the first opportunity." Also apparently people can carry in state courtrooms now.
 
Friend of mine that's a leo brought up an interesting point. Are cops supposed to assume everyone open carrying is licensed or stop them to check?

This could lease to felons carrying openly so cops would assume they're licensed or create a huge amount of work and trouble for both the cop and citizen if they have to check everyone.
 
Adam... they could. And I am sure that some will.

Good officers read people. You can tell who is waiting for his wife at the store... and you can tell who is casing the cash registers-most of the time.

Open carry or not... bad folks usually go the other way when a cop shows up. People who have nothing to fear or hide stick around.

Not to mention... in open carry -discretion goes a long way to avoiding a public disturbance. You will see a few knuckle heads toting big guns in big rigs... they will get some negative attention.

At least that's what I learned in OC country before i came here...

Some highlights of the Bill:

The first difference is that the word "concealed" is struck from the language of the SDA.

At 1272.1 A., the language "or unconcealed" is first added to the "restaurant clause" regarding on-premises consumption of beer and alcohol, and appears regularly throughout the text of the Bill.

Significant adders & strikethroughs:

The first occurs at 1289.6 A. 6.

"6. For lawful self-defense and self-protection or any other legitimate purpose in or on property that is owned, leased, rented, or otherwise legally controlled by the person; or ...."

The second occurs at 1289.7a A.-B. where the language "or ammunition" is shown as being excluded from prohibited items in parking lots and vehicles in those lots by business owners, employers, etc. From what I gather there were some employers who, since they couldn't ban guns in the parking lot, were banning ammunition there.

The third occurs at 1289.24 A. 3. (the preemption clause) where language is added thus:

"3. As provided in the preemption provisions of this section, the otherwise lawful open carrying of a handgun under the provisions of the Oklahoma Self-Defense Act shall not be punishable by any municipality or other political subdivision of this state as disorderly conduct, disturbing the peace or similar offense against public order."

The fourth and fifth occur in the definitions:

1290.2 A. "2. “Unconcealed handgun” means a loaded or unloaded pistol carried upon the person in a belt or shoulder holster that is wholly or partially visible, or carried upon the person in a scabbard or case designed for carrying firearms that is wholly or partially visible; and..."

1290.2 A. 3. "a. has an overall length of less than sixteen (16) inches and is able to be fully concealed from detection and view,...."

The sixth and seventh (and very crucial) occur at 1290.8 B.

"The person shall display the handgun license on demand of a law enforcement officer; provided, however, that in the absence of reasonable and articulable suspicion of other criminal activity, an individual carrying an unconcealed handgun shall not be disarmed or physically restrained unless the individual fails to display a valid handgun license in response to that demand."

and C.

"Said identification to the law enforcement officer shall be made at the first opportunity."
 
Thank you for posting this; very interesting. I have partially read "Enrolled (final version)" under the "Versions" tab; reading this answers alot of questions we may have. It seems the fines and terms of imprisonment for violations are pretty light.

I still have mixed views on this issue; I will continue reading.

You're welcome, Sandy. I have a viewpoint on this topic that goes the direction of "....shall not...." but I just wanted everyone to be able to find the pertinent language easily.
