Yep Thats the only mistake he made in my opinion. First words out of his mouth should have been " i wanna speak to my layer". But that all comes back to what was going through his head. I cant imagine. I think they TRY to teach you this in concealed carry class. Its like everything else, most people have to do something 3 times to remember it. That would suck.:blink:

The first words out of his mouth should have been, officer, that man tried to kill me. I had to shoot in self defense to save my life.

Then call your attorney. LEO,S in okc are given 48 hours before having to make a statement if they are involved in a shooting for a reason. Emotions are high, adrenaline is pumping, and it's not the time to be running ones mouth.

the victim was'nt a hardened criminal. He was a 16 YO kid that did something stupid with a younger friend. Is his accomplice not facing Murder 1 charges in the death of his friend? Everyone made bad choices that day and they are paying for it.

Tried by a jury of peers and convicted. Got a better system? Troy F is spot on.
 
True....none of us will ever truly know what was going on in his head (and his body) during this incident. Could adreneline have gotten the best of him? Maybe, he sure was clear seconds later when he dialed the police.

But for the sake of argument lets say that he was in "Condition Black". How to control this? Or at least lessen the effects? Combat breathing...autogenic breathing....focus breath (Seeklander's term). Breath in hard and deep for a full 6 seconds, hold for 4 seconds, and breathe out for 6 seconds, repeat. This stimulates the Vagal nerve (help me out with spelling DocJJ), which in turn slows your heart rate down.

So how do we apply this? After a shooting you may not remember to do this. So let's start practicing now. Next time you feel anxious, pissed, scared, anything that get you going.....Breathe like I described above. Feel the calming effect on your heart rate. Do this everytime you get jacked up. I do it right before I shoot, and right after. So does Seeklader. Cops have been doing this for years in training. If you do this enough, it will become second nature.

Bad guy attacks you, and you counter. Threat is over. BREATHE.

Okay, I will close the most epic thread drift of all time.
 
And let me clarify one more thing....I don't completely disagree with anyone who has posted in this thread. I understand you frustrations over this deal. I truly do. But don't let your anger and emotions get the best of you. If you are in this forum, you are probably a good person. A responsible gun owner. I understand people's frustration with our legal system. I know people get fed up with crime, violence, and a perceived (and sometimes real) lack of support for your local law enforcement agency.

It is not my intention to argue with anyone here. I just simply want to point out that he was legally in the right, and then in the wrong.
 
Have you guys seen the video with the overlaid 9-1-1 audio? He was completely lying from the second he picked up the phone. The fact is he shot until the threatening person was stopped. It should have ended right there. And then he returned to said person and finished him off. Had he not returned to the suspect and fired those additional rounds, which were shown in court to be into an unconscious suspect, we would not be having this discussion. He went to far. Does his sentence (which has not been handed down yet) fit his verdict? I don't know from an ethical standpoint, but from a legal standpoint....yes.

He defended himself and his employees, and rightly so. Then he went to far. He lied to the investigating officers at every turn. He lied to the media. He played on public sympathy. He shows up for court with handcuff key in pocket. Is this the type of behavior that you want to put on a pedestal and project as the symbol for individual self defense rights/gun rights? He set us back further than he propelled us.

I'm as pro 2nd Amendment as the next guy. I'm way more pro Self Preservation than most, even fanatical if you were to ask some administrators.

This event hurt us. But we should learn a lesson from this. When the threat is no longer a threat, you are done with the work at hand.

KOCO has the initial police interview on their site. There are about 10 3:00 minute videos there for about 30 minutes total, and it looks like it's complete. I watched them last night and was just floored. I'm now convinced Ersland is hooked on the opiate drug he takes for his back. Yeah it's that bad! The dude was lying his ass off from the get-go or hallucinating while the thing went down. Maybe both.

He screwed himself when he proved his word can't be trusted, which continues even still. But I still can't see the charge pressed against him. Prater went over the top on some of his comments during trial, there's no doubt and he also went overboard on the Murder 1 charge. Man1 would be more appropriate.

For the record, I was just pissed when charges were filed. But now I can understand them just not the end result. Hope this makes sense.
 
Hearn makes perfect sense. Yeah, I've seem the interviews too. The guy ain't right.

Back to the original post, does his conviction het overturned? Ain't happening. For the reasons, lined out above. It can't. It just simply can't.
 
COULD the Governor pardon him? Does she have that power (on her own) or does something else have to happen before she can consider it?

I could be wrong, but I think he has to be sentenced, transferred to DOC custody, and the pardon and parole board has to be petitioned first, then make a recommendation. Then the governor can do something.
Something like that anyway. I may ask a buddy next time I talk to him. His dad is a former warden and long time heavyweight in the prison system.

This mindset just simply floors me. I can't understand how some people can trivialize the events that led up to this incident. "Something stupid with a younger friend" is stealing liquor from the folks or ditching school. Armed robbery does not fit that category. There are plenty of youths in the system for murder who wern't "hardened criminals" when the went out & killed somebody. Look at the "Charter" school Speedy went to. This is not a math/science type charter. And he didn't get placed there because he was a great kid.

That's the thing about life when you play in the wrong playground, most times you don't get a second chance. The 16 yr old kid and Ersland don't get a do over and now they have paid the price. Armed robbery and the results for all are serious business, not like TP'ing a house or knocking over mail boxes. Both actions are very serious with serious consequences.

DO not go robbing and killing and you will not get killed. Mary Fallon has already stated she will do nothing with this till it has run the appeal process. I do think though that people who do not lobby to get rid of David Prater at the next election are asking for problems in the future. He and Bill Citty are not friends to gun owners.

I have a feeling we are about to watch a small business owner get their butt handed to them for an employee doing something stupid. I'd feel differently if Ersland hurt someone working within his capacity as a pharmacist, but what happened is completely outside his duties and outside the control of the pharmacy owner. But they are really going to feel the pinch on this one.

Very good point. This will be the part that rubs folks the wrong way. The dead kid's family sues, and will get a settlement. I think someone should introduce legislation that states something similar to this "if you are engaging in an unlawful activity and you gewt hurt...your bad. Now piss off".
 
I'll get to introducing that as soon as I finish law school, you fools elect me, and I tweak to divorce/child support laws. Lol
