The Ersland case, trial and verdict have been discussed to death. But I am wondering with all of the uproar after the verdict, is there really any chance that something will/can be done?

Will the petition really do any good? Does the Governor even have the power to do anything?

I don't believe he has been sentenced yet, so public opinion and the petition may very well have some say about how long of a sentence he may serve.
 
Ersland made several mistakes and deserves to be punished at some level. I wouldn't have handed the sentence that they did. I would also not have taken a tax paying business owner out of the system for defending himself in his own place. I DO NOT see this verdict getting over turned. Anyone with the political power to do anything will not have the political will.
 
COULD the Governor pardon him? Does she have that power (on her own) or does something else have to happen before she can consider it?

I probably should use the term conviction. Dennis is correct in that Ersland has not been sentenced as of yet.
 
I always thought that the same rules applied to your place of business as your home, especially if your the owner. What would the verdict be if he was at his house and the same was caught on tape? Frankly i would have probably done the same amount of trigger pullin. Maybe more. I cant imagine that his head was right at all after that first shot.

Its really just a bunch of bull elephant dung. Facts are that he was defending himself and the people that were there with him. Now what is the next business owner gunna do when two people come in with the intent to rob or do harm.

i really dont care what he did after they walked in and threatened him.

Damn cameras. Least he is alive and will more than likely get a parole shortly after being incarcerated. If he didn't have a gun, could be the complete opposite outcome.
 
I think this is a classic case of KEEP YOUR MOUTH SHUT. That being said, I don't think the prosecutors made any friends on either side of this one.
 
You're right, not a classic case at all. What I meant was that no matter what the Jury's decision is, he is alive after a self-defense incident. But no, this isn't classic at all.
 
Hahaha. Not you! Ersland. He shouldn't have talked to the cops until he got a lawyer. He was on tv right after it happened telling all about it. I think there is a chance not any of us would have seen that video either.
 
Have you guys seen the video with the overlaid 9-1-1 audio? He was completely lying from the second he picked up the phone. The fact is he shot until the threatening person was stopped. It should have ended right there. And then he returned to said person and finished him off. Had he not returned to the suspect and fired those additional rounds, which were shown in court to be into an unconscious suspect, we would not be having this discussion. He went to far. Does his sentence (which has not been handed down yet) fit his verdict? I don't know from an ethical standpoint, but from a legal standpoint....yes.

He defended himself and his employees, and rightly so. Then he went to far. He lied to the investigating officers at every turn. He lied to the media. He played on public sympathy. He shows up for court with handcuff key in pocket. Is this the type of behavior that you want to put on a pedestal and project as the symbol for individual self defense rights/gun rights? He set us back further than he propelled us.

I'm as pro 2nd Amendment as the next guy. I'm way more pro Self Preservation than most, even fanatical if you were to ask some administrators.

This event hurt us. But we should learn a lesson from this. When the threat is no longer a threat, you are done with the work at hand.

Yep Thats the only mistake he made in my opinion. First words out of his mouth should have been " i wanna speak to my layer". But that all comes back to what was going through his head. I cant imagine. I think they TRY to teach you this in concealed carry class. Its like everything else, most people have to do something 3 times to remember it. That would suck.:blink:
