look at 1290.22 for business owner's rights
as far as the defense of another that's what it says in the lesson plan, Iam still researching the legal aspects of it.
I don't believe that's law, I do believe it is put in the lesson book to add some reality to peoples dreams of recuing the damsel in distress hero senario, its a good decision to not get involved unless you know the whole situation, I mean how do you know the person your "saving" didn't just cut someones throat and walk out and what you are seeing is a family member of the victim trying to detain or stop the attacker
So if I'm correct you can legally protect anyone in inmediate danger of great bodily harm, but if you don't know the situation, and what happened before what you encountered it, best decision might be to stay out of it for yours and others protection.
This is all my undersatnding of the laws and suggestions and I could be wrong, let me know what you think.
For good measure here's a senario,
Your walking down an aisle in walmart, you hear a man and women scream then several others scream and run away. Being the good sheepdog you are you approach the area of the comotion as you peek around the pop tarts you now see a man pointing a gun at a woman and demanding that she get on the ground and says if she moves he will shoot. You are legally caring a firearm.
You have only a split second to decide.
Option A. Flight, as you have a clear path to flee, you could easily escape the situation.
Option B. Fight, you are armed and the distance isn't that more then 10 yards and there is little chance to hit anyone other than the target that you can see.
Option C Observe and report, sometimes the best solution is to ignore fight or flight and become a crediable whitness, some situations allow only this soulution.
What really is going on, the women pulled a knife on her boyfriend who she found in walmart with his on the side girlfriend, she attacked him, as he slipped away and she started a chasing him a fellow sheepdog who was present for the whole situation drew on her and commanded her down for his and others protection, giving statements that he would use force if she advanced. You don't see the Cheating BF because he ran, you don't see the knife because its behind an obstruction, such as a coffin freezer or just around those wild berry pop tarts.
Did you shoot the law abiding citizen? Did you miss and kill the 18year old girl in the stock room?(misses happen to everyone even more so while under preassure and stress, well except for Accurate Ron)
Well anyway on with life.
