Looking for some help here... Set up a trust for NFA items first of 2013. Long story, financial hurdles, new marriage, etc.. Looking to get a couple stamps purchased, but one of the successor's on my trust was charged with a felony last fall. Was pretty sure he would be found innocent of the charges when he went to trial this month. Didn't happen. He now has a big red F on his head.

My questions are:

1. I'm pretty sure I will need to remove the individual from the trust, but will this affect going ahead and purchasing the stamps?

2. Do I need to re-do the trust immediately, even if they individual is the 5th person down the successor list?

I'm pissed over the deal, and never even imagined something like this could have happened.

Any help in this matter would be greatly appreciated!

A trust is simply a legal document. You can change beneficiaries pretty easily. Just take the felon off the document.

If they are the fifth person down the list chances are they will never see the gun and if they do you'll be long gone by then.

a felon doesn't mean anything either, I'm a felon with a full pardon, I have a SDA license and can purchase weapons, class 3 too!

How exactly does that work? If you have a pardon wouldn't that make you not a felon?

you have to get your record expunged, Oklahoma law says if you have more than one on your record you cannot, so I guess I am still a felon, but the SDA says if you get a full pardon for a non-violent crimes your rights are restored to get a SDA license, be a peace officer, etc. I have owned my own armed PI-security business and I have brought a Beretta Px4 Storm Sub-Compact and a Ambush Arms AR15 since then! when you buy a gun you answer like your not! the first time it took awhile, OSBI did not send the pardon to ICE! I am in the process of getting a silencer.

all happen in 1986, 3 counts of DUI, Possession of Marijuana and CDS, got 5 years each they ran concurrent for 5 years, did 30 days in Lexington, a week at a medium, 6 weeks at Fort Supply for treatment, then a halfway house for a year an half, then house arrest, was release from there cause of over crowding, 2007 Gov. Henry gave me a full pardon

and I still got my job at GM, they never knew, I took a leave absence
