Legal Help- "Tranportation of a Military Firearm"

Nice statutory analysis. However, to get a complete picture you need to A. look at the legislative notes on the code sections cited (would explain exactly what the legislature meant the bill to do) and B. more importantly, relevant case law.

Don't worry, I know. I forgot to insert that caveat, but it was in my mind though.

It's a sham that lets the government do what it wants to.

The Government:
"Oh, the statute said "A"... well the legislature's intent was really "B", but the judge said it really means something else totally different... so you're going to jail."

It's a coup, just like the CONstitution and the strong central government that came with it.

Been following this thread closely as I routinely transport my firearms in the back seat of my car when going to the range. Unloaded, but the bolts are in them. I do not have a truck and don't like them all bouncing around in the trunk with the target stands and ammo cans, as they are not all hard cased.

Folks, I got a text today from my friend. His charges have been dropped. I'm waiting to hear more as soon as he hears more from his lawyer about the details, but the important thing is he is free and clear.

I would like to note that SLED pulled his CWP in late December due to the pending charges and he was restricted from traveling out of state. SLED is supposed to reinstate his CWP now, I do not know how long that will take.

I want to thank you all for your support, advice, words of encouragement, etc. Ya'll are a good bunch. If there is something that we can take away from this mess, it is that you can be hit with charges you would never have anticipated or dreamed of, and that don't make sense one bit just because of an officer's perception. It's not exactly comforting.

Anyway, thanks, and I hope no one winds up in a similar situation such as this. This isn't over but obviously I cannot talk about what may come down the pike right now but I will update this thread again if anything else develops. Be careful out there ya'll!

Wow-what a coincidence! I had just read your post when AG's dad called me to tell me the news. I didn't even know about the CWP. They're deciding what to do next but I gave them my .02 cents worth. Very glad for AG that it worked out like it should have but there was really no reason for this mess to happen in the first place. We should all be afraid that LE doesn't know the laws they're supposed to enforce!
