HB1647 Passes House

Last night, about 11:30PM or so, I watched in horror as the Oklahoma House passed HB1647 purporting it to be an open carry bill.

This is the bill that requires a person to articulate a "reasonable fear of bodily harm" in order to open carry. The Virgin amendment added a requirement of a protective order in effect.

In other words, open carry is still a criminal act by default in the State of Oklahoma with this bill.

Is there any chance that this bill even makes it through the Senate anyway? We may be all up in arms (pun intended) about nothing if all of the same crap happens when it gets over there.

Brian has been making a yeoman's effort keeping all this straight at " the other site".

Our SOB State House seems to be hell bent on running "something" that sound good that in essence erodes rights under the cover if legalistic double-talk .

As we approach Passover, we should all remember another grand legal body who liked to railroad people (Jesus), under the cover of darkness.
Seems like our State legislators like to do their double dealing after us chickens are on the roost too.

It passed through the Senate before going to the House.

I thought that was the SB and we are talking about HB1647? See how easy it is to gt confused. Even if it has already been approved by the Senate it will have to go back because of all of the amendments made by the House?

Hopefully 1647 dies in the Senate and SB129 lives in the House. A kid can dream can't he?

Happy Second Amendment Day, fellas

They managed to pull a bill declaring a A2 holiday out of their ass and get it passed.... While shuffling any laws that would restore or protect our rights.

We can only hope everyone nuts up and forces a discharge petition on one bill and get to the bottom of were others have been stalled on procedurals .

Negative. Different bill.

Thursday was the deadline for bills to pass their chamber of origin. SB129 is the bill for open carry with no license.

HB1796 is dead.

The only open carry bill left at this time is SB129, and it is now in Sue Tibbs' House Public Safety Committee.

Barring a committee or floor substitute on another bill in either chamber, a discharge petition of SB129 is likely our best hope to get open carry heard in the House.

What is the standard for "articulating a resonable fear of bodily harm" when it comes to carrying? Does that mean I have to suppose that someone is out to get me or have filed a protective order or ???

The way it currently reads you will have to have at least filed an emergency VPO. But as I have learned this session a bill can completely change at anytime, that just means it has to be voted on again by the other side.

Basically, you would have to prove that a reasonable man would have a fear of bodily harm in your given situation. Some proponents of the bill with the way it is written have claimed that lawyers say that citing the local crime rate would be sufficient. However, anyone who has looked at cases where the reasonable man test (or similar) was used will find that that is generally not the case.

My Senator has NEVER responded... and my Representative responded once last year. The Representative before that responded ~95% of the time, even if he didn't agree.

Funny thing is... I'm registered Republican (got be able to cast at least one local partisan vote... I'd register Democrat if I lived in town). My current rep is Republican. The previous rep was Democrat...

I've watched the live feeds a bit more this year than last year, and my current rep looks like he's doing his damnedest to get within the leadership's inner circle and stay there this year. In short, I'm not real happy with him.
