Academy Sports delay

Greetings,
I am new here and moved to Alabama from Georgia in 2016. I currently have a Georgia Concealed Carry permit and know that my Ga. CWP is reciprocal in Alabama however did not know that when purchasing a firearm I would still have to have a background check before taking possession of the firearm and my Ga. CWP is only good to carry in Alabama. Of course my check was delayed like it always was in Georgia and why I obtained a a Georgia CWP. Academy also has no obligation to sell me the firearm after the 3 day rule and would have to re apply again in 30 days. My question is.
1) has anyone been delayed for 30 days.
2) is there an easy way to transfer my Ga. CWP to Alabama vs. having to go through the whole fingerprint process, etc.
3) Has anyone submitted to NICS a request for review and just attach their out of state CWP and current drivers liscense vs. all of the fingerprint cards, etc. and delay lifted?
I am not sure exactly what the easiest way is to do this. I also won’t go back to Academy Sports as I wasn’t informed of their policy before the background check.

I've never heard of that policy with Academy. Not doubting you a bit, but the feds say that if your review doesn't come back in three days, they can go ahead and give you the weapon.
The company in general has some weak knees, typically capitulating to anti-gun sentiment by a few in the media and liberal government when one of the nations mass shootings takes place. Always hiding the MSR's behind closed doors until the media cools off. Pretty spineless IMHO.
I think the whole issue is with Academy and their 30 day policy.
Go visit a brick and mortar gun store, and I guarantee you, there will not be a 30 day delay. Fill out the 4473, and if delayed, walk out with it in 3 days unless there is some dumb state law that applies.
 
The 30 day issue may have to do with establishing legal residency state law. I have experience with some other legal court matters where you had to have a certain county or state residence established for 30 days before doing certain things.
Also, if you are a resident of Georgia then the reciprocity clause would be to follow what Georgia would allow - which is to residents. I think that may be your snag.

You may have to wait the 30 Days. Once you do that & establish residency, an Oklahoma CC may need to be on your to-do list. That might take less time than a NICS review & it should cut out the cross /multi state stuff you have going on. Just an idea.

1) Yes, I have seen this policy before at Academy. If you receive a "DELAY" for any reason, you must come back in 30 days and try again. Its ludicrous but they have every right to do so. The irony is that when you come back in 30 days, you will receive a delay again, thus preventing you from ever buying that gun from Academy.

from the FBI website: "If the FFL [Academy] has not received from the NICS a final determination after three business days have elapsed since the delay response, it is within the FFL’s [Academy] discretion whether or not to transfer the firearm"

I would guess you were delayed because of your residency

​2) I doubt you can transfer a conceal carry license to another state. That is controlled by individual states. Trump is trying to pass a reciprocity act and everyone talks like it is the best thing since sliced bread but I don't like it. That shouldn't be a federal issue is should remain with the state. That will open a can of worms that we don't need. i.e. federal license, taxes, permits.

3) No, you must always fill out a 4473. FYI, you are not fingerprinted when you fill out a NICS request
 
If you constantly recieve a "delay" you should file to recieve a UPIN from NICS.

I’m not sure about Alabama or Georgia but in Oklahoma, when you’re delayed if the gun dealer doesn’t hear back on the background check in 5 days your cleared to pickup your new gun. I had this happen to me a few months ago. The dealer called after 5 days and said that he hasn’t been contacted with a follow up so I could come pick up my gun.
