transporting long guns on motorcycle

To start, the only transportation I have is a motorcycle. The reason being that I don't want to allocate any of my gun money into a car payment :rolleyes: I generally just put my guns into a gun case and strap them onto my backseat as my bike doesn't have a luggage rack or saddlebags. This works, but it is very shaky on the freeway and somewhat uncomfortable. It is also a cumbersome PITA to load and unload the bike. I have a plan to make a rear storage rack with side mounted gun racks similar in purpose to ATV gun racks, except they would hold the guns on the same plane as the motorcycle wheels, and point the muzzle in the same forward and down at a 45 degree angle.
I was worried about the legality of transporting the firearms this way so I emailed the stillwater District Attorney Council asking him wether it would be legal:

What is the law in oklahoma pertaining to open transport of rifles and shotguns on a motorcycle. I only have a motorcycle for transportation and I compete in shooting sports. I would like to install some scabbard brackets on the bike in order to transport the long arms.

Sorry it has taken me a few days to respond, but I have been out of the office. You have offered a great question and one that I have never had to consider. Without going into detail, I would submit to you that it is fine for you to transport the rifle or shotgun open (in plain view) and unloaded. I am attaching the statute pertaining to this for you review.

Any person, except a convicted felon, may transport in a motor vehicle a rifle, shotgun or pistol, open and unloaded, at any time. For purposes of this section "open" means the firearm is transported in plain view, in a case designed for carrying firearms, which case is wholly or partially visible, in a gun rack mounted in the vehicle, in an exterior locked compartment or a trunk of a vehicle.

Any person, except a convicted felon, may transport in a motor vehicle a rifle or shotgun concealed behind a seat of the vehicle or within the interior of the vehicle provided the rifle or shotgun is not clip, magazine or chamber loaded. The authority to transport a clip or magazine loaded rifle or shotgun shall be pursuant to Section 1289.13 of this title.

Any person who is the operator of a vehicle or is a passenger in any vehicle wherein another person who is licensed pursuant to the Oklahoma Self-Defense Act, Sections 1290.1 through 1290.25 of Title 21 of the Oklahoma Statutes, to carry a concealed handgun and is carrying a concealed handgun or has concealed the handgun in such vehicle, shall not be deemed in violation of the provisions of this section provided the licensee is in or near the vehicle.

Thanks for your response. I figured that such was the case. I paralleled this type of transportation to hanging a shotgun in the rear window of a pickup truck, which I also assumed was legal because of how common that is to do. Would you be opposed to my printing these emails and carrying them with my firearms? It would just be so that any officer unsure of the law has something on paper to justify my transportation methods?

I have absolutely no problem with that, but please remember that is my interpretation of the law. Others could differ, but that is my office’s interpretation.

So, do you think I'll encounter any problems if I carry my guns this way with this piece of paper on my body? I'm also planning on holding the bolt open with one of those bright orange pieces of plastic.

Also, if anybody owns, is competent with, and would volunteer their services with a welder I would gladly come down with the materials and supply all the food, drink, bitches and/or hoes, and good times in general.

Draw up a rough sketch to what you want. I am a certified welder, and I have a welding shop,if I have bluepints I can build pretty much anything

I think you will be fine, Taymoor. I would recommend the idea you already had about mounting one of the plastic ATV rifle scabbards. Like these

If I can find one short enough, I'll jump on it. But I had a vision. As I sat upon the toilet, taking the Brown's to the superbowl, a grand idea came to me on how to make my bike the most badass gun hauler known to man! Men in my direct social circle anyhow.
 
Last week I saw the Amry National Guard bike that was built by those Orange County guys. It had a M4 mounted to it, that was a badass bike

It was a demilled AR. and Burk, I'll get some drawings going. It might be difficult to translate what is happening in my head onto paper, but I'll give it a try
