Doesn't the new law coming into effect on Nov 1 cover this?
Short form is that you must inform the officer at the first available opportunity, not immediatly.

Somebody that is in the LEO profession correct me if I'm wrong, but when they run your tag before they approach your vehicle, they already know if you have a CCL..

I had a minor accident this year. When the OHP came up, I gave him my DL. He then asked me if I needed to tell him anything else. I reply'd no, as I had a couple of pistols in the vehicle, but they were unloaded, and the mags removed. (I had been in an area that didn't allow loaded guns.)

So, I'm pretty sure now that CC owners are flagged by their tag numbers, and possibly by their DL's.

What makes me uncomfortable about this, is that its a back door method of gun registration.
 
Not true Dennis. There are no flags on DLs or Vehicle Registrations.

I just confirmed this by falling my dispatch and asking them. I also had them check the DL status of my father, who has a SDA. Nothing popped up.

OHP can tell if you have a CCL and they check to see if you do routinely.

Then they must be running a seperate database available on to them. Which is possible. After reading this I spoke with an OCPD buddy, and he said they cannot get the status off of DL or License Tag either. I was told by our OLETS Supervisor the only way to check is to run someone's Criminal History. That will show if a person has one. Or if they are a teacher, any profession that requires fingerprinting, etc.

As a cop - I would like to know.

As a citizen - I think it's unconstitutional.

And yes. There are bad cops out there. There are antigun cops out there. There are cops on a power trip out there. But they are the minority.

The open carry law will cause some problems, of course. Cops will have to learn the rules and abide by them or become a YouTube sensation.

We all hope this is what will happen.

I'm not so worry'd about LEO's. Its the citizen freeking out and going nuts is my main concern.
For me, it will just be another day of concealed carry. I have no plans of OC.
 
OHP can tell if you have a CCL I found this out when I got pulled over. I always tell them about Boomershooter and if I have good reception I have pulled up 3gun videos on my phone.

There is a database for everything. Has to be. So maybe since OHP is a State Agency they have access to that Database when the rest of us don't. That to my mind is most likely scenario. However, I just occurred to me.....I'm calling their Training Divison right now. I will get the skinny for you guys.
 
Just got off the phone with Troop A Headquaters. OHP does NOT have the capability to know if you have a SDA. There is nothing about your tag or Driver License to indicate SDA status. The only way to find out if someone does have a SDA, is if the Trooper (or any of us) have your DL number. Quote from OHP "we ain't that high tech".......

Once we have your DL number, we can get your DOB. Using your name and DOB, we can then run a Criminal History. That will tell us if you have a SDA.

There is no way a Trooper will know if you have a SDA prior to him retreiving your DL. And that came straight from the Oklahoma Highway Patrol to my office.

Good info, thanks Troy for your time to track that down. Actually that makes me feel pretty good that info is only available in that format as anything else would make me feel uncomfortable. Not that I have anything to hide but I could imagine possible abuses to the system.

I don't dare video these incidents, I immediately pull over and say yes sir & no sir I figure it might make the difference between a slap on the wrist or a monster ticket.
 
After being legally stopped for traffic violations, (twice in the last 2 weeks) because this is a notify state, presenting my drivers license and insurance forms I also handed him my ccl. Both the sheriff deputy and the police officer asked its location, after advising them of its location and their advise to keep my hands on the steering wheel, I was given written warnings. Both were polite and profresional. Informing leo's immediately sometimes can be a good thing.
 
I dont mind showing mine and suprisingly they seem to be a little more comfortable with me afterwards. I just thought it might be unconstitutional but like I said I dont mind doing it.

On the second question, I'm a bit confused. Do you mean "do I have to notify Edmond PD if I plan on carrying openly" or "do I have to notify in the event I am contacted by the police"? The first would be a "no". The second a moot point because if you are carrying openly, the police would be able to see it.

And I'm sure to get trashed for this, but in regards to first thought.....a law is constitutional until proven otherwise. At face value. So though we may feel a law is unconstitutional, until a court says it is not......law of the land and must be obeyed.

If I have a gun especially open carry when I get stopped I plan on informing the officer immediately.
I do not know what kind of experiences he has had in the last hour, day, week or month and I don't want to look down the barrel of his gun just because he is a little on edge do to a x wife making his life hell.
 
Yes, even open carrying make sure you point it out. If you're in your car or they approach from the sidethey may not see it. Better to state the obvious than surprise a cop with your gun. :)
 
Troy you are without a doubt right about laws being consititutional or not but I think many people have made a decent argument to the thought if it were tried it may be found to be unconstitutional.
