Federal Apellate Court strikes down IL concealed carry ban

The state of Illinois would have to allow ordinary citizens to carry weapons under a federal appeals court ruling issued today, but the judges also gave lawmakers 180 days to put their own version of the law in place.

In a 2-1 decision that is a major victory for the National Rifle Association, the U.S. Seventh Circuit Court of Appeals said the state's ban on carrying a weapon in public is unconstitutional.

"We are disinclined to engage in another round of historical analysis to determine whether eighteenth-century America understood the Second Amendment to include a right to bear guns outside the home. The Supreme Court has decided that the amendment confers a right to bear arms for self-defense, which is as important outside the home as inside," the judges ruled.

"The theoretical and empirical evidence (which overall is inconclusive) is consistent with concluding that a right to carry firearms in public may promote self-defense. Illinois had to provide us with more than merely a rational basis for believing that its uniquely sweeping ban is justified by an increase in public safety. It has failed to meet this burden.

"The Supreme Court’s interpretation of the Second Amendment compelled the appeals court to rule the ban unconstitutional, the judges said. But the court gave 180 days to "allow the Illinois legislature to craft a new gun law that will impose reasonable limitations, consistent with the public safety and the Second Amendment as interpreted in this opinion, on the carrying of guns in public."

They'll probably still find some way to make it really difficult for people to carry, but this makes me happy. I haven't read the opinion, but I'm not sure how they would make it "may issue" while meeting the judge's requirements.

I just read the same basic story on Fox News and CNN.
I believe they will have to make the law somewhat like Oklahomas, in that it will be a shall issue if you meet the background check criteria. I was looking for the law/bill they mentioned that was Ready for the state senate...

" A new law could be in place by January, Pearson said. A bill has already been written by Rep. Brandon Phelps that includes background checks, field provisions and other issues. "

But I could not find the text of the bill anywhere on the web,
 
Downstate has been trying for CCW legislation for quite some time now, and a bill is currently kicking around the state House of Representatives.

The current bill is pretty standard: shall-issue, classroom & live fire tests, local law preemption, etc. Unfortunately, the preemption means that it needs a supermajority to pass. They will probably have to add a bunch of restrictive hoops to jump through in order to get votes from north of I-80.
 
I have no knowledge or experience with the Illinois legislature, but given the 180 day time limit, the bill will probably end up with many ammendments if not being rewritten completely, in order to get it to pass in that short time.
Most politicians don't like to be put under pressure and tend to act out when they are.
